I would need to know a lot more about the incident before I can respond properly, were they doing work at the time?. If they did pay you it would open the flood gates and they would be broke in no time so they will fight hard. They may be using the insurance company as an excuse to get you off their back as they are likely to be self insured or they would have an excess way more than $5000 ie they would be paying the whole amount themselves. Who was it said they were liable – a receptionist or their risk/insurance manager?. You could try and sue them but you would have to prove that they did or should have known about the condition of the ground and that your bike would fall over and if it was that bad already they could say you shouldn’t have parked there and contributed to the incident. Is your bike insured?? If you want to pursue it you would have to hire a lawyer.
Hi I parked my motor bike in a local government car park , grafton NSW main tsreet Prince street. The ground beneth crumbled making the bike fall over .
I got witnesses and photos taken plus quotes , The localgovernmetnclaimed they were liable but refered it to their insruance company who now state they will not pay .
I am in a bad situation as my bike has $5000 damages
